Recently Proposed and Adopted Commission Rules
The Commission has proposed the following rule changes, which are being published for public comment in April 10, 2026, issue of the Texas Register. Click on the rule links to review the changes proposed by the Credit Union Commission at its most recent meeting. Summaries of the changes are below, and in the linked PDF documents, new language is underlined, while language being removed is shown by a strikethrough. Proposed March 27, 2026; submit comments by May 10, 2026
Amendments to Section 91.709, Member Business and Commercial Loans
If adopted, these amendments would:
- change the defined term “control” to “controlling interest” in the context of commercial loans and revise the definition accordingly
- make non-substantive changes to the rule for clarity
Amendments to Section 91.714, Leasing
If adopted, these amendments would:
- delete language about acquiring property for the purpose of leasing
- add a reference to Section 91.401, Credit Union Ownership of Property, which prohibits acquisition of real estate by a credit union for the purpose of leasing
Amendments to Section 91.1003, Mergers/Consolidations
If adopted, these amendments:
- simplify the definition of “premises”
- delete references to terms that were removed from the rule when previous amendments were made in 2015
- change the time for a credit union investing in property to put it into service for credit union business to six years and create a process for requesting an extension of time for consistency with the NCUA regulation
- make organizational and other non-substantive changes for improved readability
Amendments to Section 95.105, Reporting
If adopted, these amendments would:
- update the title of Section 91.209, which is referenced in this section
- make some non-substantive edits for readability
Amendments to Section 95.108, Examinations
If adopted, these amendments would:
- move the provisions of Section 95.109 regarding examinations of insuring organizations and the fees for those examinations into this section
Amendments to Section 95.110, Enforcement; Penalty; and Appeal
If adopted, these amendments would:
- update the title of Section 93.401, which is referenced in this section
Amendments to Section 95.302, Powers
If adopted, these amendments would:
- update the title of Section 91.701, which is referenced in this section
Amendments to Section 95.305, Audited Financial Statements; Accounting Procedures; Reports
If adopted, these amendments would:
- update the title of Section 91.209, which is referenced in this section
Amendments to Section 95.310, Fees and Charges
If adopted, these amendments would:
- update the title of Section 97.113, which is referenced in this section
Repeal of Section 95.109, Fees and Charges
If adopted, this repeal would:
- delete this section because its provisions are being moved to Section 95.108, Examinations
